We will need the following information:
3 years tax returns
6 months pay stubs (or proof of income)
Last 3 months bank statements on all accounts in your name
Car titles
Deed on house
Credit Reports (If you don’t have recent ones we can secure them for you)
Bills copies with account numbers and name of creditors
Debts list
Copies of any lawsuit documents
Copy of your lease if you are leasing your home
We will ask you to fill in a questionnaire on paper or on the computer.
We then compile in the information into a petition for bankruptcy and analyze it to be sure you are qualified for a Chapter 7 or determine that you may only file a Chapter 13.
We file the petition online. After it is filed, creditors are stopped from calling you or trying to collect. Any garnishments are stopped.
A creditors meeting is scheduled about 5 weeks after you file (341 hearing). You must appear at that hearing to allow creditors to ask any questions. Most do not come to the meeting. If you owe money to the IRS or State Tax Commission they will file a claim so you can arrange to pay what is owed.
Most issues are resolved by the time of the creditors meeting. After the meeting is over, a final discharge from the Chapter 7 about 6 -8 weeks later.
